Call Recording and POPI compliance
The Protection of Personal Information Act, South Africa’s data privacy law, was drafted in 2003, approved in 2013 and came into effect in 2020 with a grace period of 12 months. Compliance becomes mandatory on 30 June 2021.
Under POPI (Protection of Personal Information), individuals have the right to obtain a copy of the recordings containing their personal information from a call center.
When a company is not legally entitled to that information, an individual may rightfully demand its deletion.

Compliant Call Recording
The Protection of Personal Information Act (or POPI Act) is South Africa’s equivalent of the EU GDPR. It outlines the conditions for responsible parties to lawfully process the personal information of data subjects (both natural and juristic persons). The POPI Act does not stop companies from processing and does not require them to get consent from data subjects to process their personal information.
